Prison for a 74-year-old man who harassed a boy in an apartment

SINGAPORE – An elderly gardener who worked in a cooperative offered a boy living there $ 2 to buy ice cream and asked him to meet him later in a barbecue pit.

Although the boy rejected his offer, 74-year-old Tok Chon Chei was not hindered. The man carried the boy away after seeing him again in the condominium two days later. He then asked the boy to have sex with him.

Tok was sentenced to one year and nine months in prison on Tuesday (May 4th) after pleading guilty to abusing a person under 1

4 and providing an indecent act by the boy. Another charge of aggravated violence was considered for his sentence.

The boy, who is already nine, cannot be named to protect his identity.

The court heard that the boy had known Tok for at least two years, as he would see the man take care of the plants when he returned from kindergarten.

On March 21, 2019, the boy came across Tok sitting in a chair. Electric offered the boy $ 2 to buy ice cream and asked him to meet him later in the barbecue pit. The victim did not take the money and did not meet with Tok.

Two days later, the boy and his sister left home to play on the condominium playground in the morning. They then returned home to drink water before riding bicycles.

Electric was in the area and asked the boy to come to him. The boy’s sister returned home unaware that something was wrong.

Then Tok carried the boy on his lap and kissed him on the lips.

A witness, a resident of a woman, was walking near the side gate when she saw the meeting. She recognized both the boy and Tok. The witness left the condominium, but returned because she felt uneasy about what she saw.

Meanwhile, Tok asked the boy to stand up and touched the boy’s crotch. Tok then unzipped his own pants and asked the boy to have sex with him. When the witness arrived, she saw the boy facing the man and touched the man’s penis.

She asked Tok if he thought what he was doing was right. Tok got dressed and began begging the woman not to report on the matter. The witness replied that he had to be reported. She went to the security post with the boy, the man begging her before she left.

The witness told the security guards what had happened and the victim’s parents had contacted him. The boy’s father filed a police report. Police later arrested Tok.

Past conviction with a young boy: accusation

Tok was jailed six months after he was convicted in 2013 of sex crimes against an 11-year-old boy. He harasses the boy over his underwear and kisses him on the lips. While the two were in an elevator on an HDB block a little later, Tok kissed the boy again.

Deputy Attorney General (DPP) Nicholas Lai noted that in his latest crime, Tok took another step forward to ask the boy to have sex with him.

“In the present case, the accused offered the victim $ 2 to buy ice cream, although the victim did not intend to meet with him. What we can see from the facts is that he has an attempt at intent (s), illustrated by the offer. of two dollars, whether they resulted in fruit or not, this will be considered by the court, “DPP Lai said.

Tok’s lawyer, Benjamin Lee, said there was no breach of trust and that Tok’s contact with the boy was fleeting.

“Given (he is elderly) at 74, the long prison sentence will be crushing, he could potentially die in Changi, so the defense represents a 12-month prison sentence given his advanced age,” Lee added.

To secure an indecent act from a child, Tok could face up to five years in prison and / or a fine of up to $ 10,000 in a first sentence. For abusing a person under the age of 14, he or she could be imprisoned for up to five years and / or fined. He cannot be a cane as he is over 50 years old.
