The Associated Press reported that a Delaware judge had ordered communications between Musk and his in-house attorney to be unprotected, while ruling that other communications sought by shareholders’ attorneys remained secure, including communications between other Tesla board members.

Shareholders have accused Tesla of approving a large-scale Musk compensation plan, which they say was drafted by Tesla’s internal adviser Todd Maron and deputy internal adviser Jonathan Chang, without the board’s participation. Tesla denied the allegations.

The company has approved a compensation plan for Musk in 2018, which could be worth more than $ 50 billion. Musk also runs SpaceX, a private space flight company that seeks to place private astronauts in space around the moon by 2023.

“Using his control, close personal relationship and reputation for retaliation, Musk co-opted Maron and Chang to help him structure the plan without the commission’s involvement,” the plaintiffs’ lawyers wrote in requests for release, according to the AP.

“Musk and his agents have submitted a fully-fledged plan to the committee,” they continued.

The Hill turned to Tesla for comment.
