Tommy Martin said he believed that the color of his skin had led him to serve less than the toppings than other people would get. Martin is black.
According to the case, a treasurer tried to correct the problem, but his manager said he was served correctly.
The case was handwritten and filed with the US District Court in Charlotte. According to the Fayetteville Observer, Martin said the event broke the 14th Amendment and gave him a cybidophy, a fear of food.
Martin said his manager had recovered the money for his purchase, but he still wants the jury to hear his case.
