The brutal attack ran into the Orange County Jail in Santa Ana when Josh Waring was on his way back to his cell. He never got there because another prisoner jumped out, carrying razors wrapped in towels.
This video of the October 9 parting show shows that the attacker sneaks into place – hiding under a staircase – and then Josh, in pajamas and sandals, suddenly fights for his life. The fists begin to fly and Josh defends well for a while – getting a few shots in the head – but eventually suffers deep blows to his chest and face.
The brawl – which moved outside the camera but was still visible in the mirror – lasted for nearly 90 seconds and stopped only when security rushed inside … commanding both men to come down to earth.
Josh's lawyer, Joel Garson, tells TMZ … his client was returning to his cell in the prison's ward after making a phone call. He says the normal protocol is to keep all other inmates in their cells while another inmate uses the phone.
Garson says that the guards must confirm through the intercom that the other prisoners are locked up. There is no sound on CCTV, so Josh's lawyer says he can't say whether the protocol is complied with – but says he would not be surprised if the attacker was left outside his cell.
Garson is arguing that this could be revenge against Josh for bringing a federal case against Orange County and his sheriff's department for violating his civil rights while he is behind bars.
Another video shows Josh receiving medical treatment after the attack. He is surrounded by lawmakers as he describes his injuries. He was concerned that the razors used against him were not sterile and could be contracted to the STD.
We are told that there are 20 stitches on his chest and face that are cut from the left eye down to the chin.
The County Sheriff's Office tells us that a criminal investigation into the attack has been opened.

Josh has been incarcerated since 2016 while he is awaiting trial for attempted murder. He is accused of shooting a man in a sober residence in which he lived.
He could receive life in prison if convicted.
Garson tells us, based on this video, they are considering adding new lawsuits to the federal case they have already filed against Orange County.
